Disclosure Statement and Consent to Electronic Communications, Disclosures, and Signatures

PLEASE CAREFULLY READ THIS DISCLOSURE STATEMENT AND CONSENT TO ELECTRONIC COMMUNICATIONS, DISCLOSURES, AND SIGNATURES (THIS “E-CONSENT”) AND PRINT A COPY OR RETAIN THIS E-CONSENT ELECTRONICALLY FOR FUTURE REFERENCE.

Introduction

You (hereafter “you” and “your”) are submitting a Loan Request Form to Ningo Lending LLC dba Spotloan Plus (“Spotloan Plus”, “we”, “us”, and “our”) and authorizing our tribal affiliated lenders to obtain your credit (“Credit Authorization”). In order for us to (a) process your Loan Request Form, (b) for our tribal affiliated lenders to obtain your credit, (c) use and accept electronic signatures, and (d) electronically provide disclosures and other communications related to your requests, credit inquiries, applications, and any credit or other transaction documents that we may enter into with you (now or in the future), we must obtain your authorization as provided in this E-Consent. As used herein, “Communications” means any loan request forms, agreements, legally-required disclosures, notices, documents, policies, statements, information and other communications.

Scope of E-Consent

By agreeing to this E-Consent and proceeding with your Loan Request Form, we may share your consent with our tribal lending affiliates so they may obtain a credit inquiry, you are acknowledging and agreeing to conduct transactions electronically with Spotloan Plus, to submit your Loan Request Form, obtain your Credit Authorization electronically, and to receive Communications from us electronically. You also are agreeing to all of the terms and conditions in this E-Consent. 

Communications that we may provide to you electronically include but are not limited to: (a) information about your Loan Request Form; (b) communication about or a matched lender, counteroffer from a matched lender, (c) our privacy policy, and this E-Consent; (d) related disclosures and information; and (e) all other agreements, disclosures, notices, documents, policies, statements, information and other communications from us.

You may choose not to agree to this E-Consent, but if you do not agree will not be eligible to be matched with an affiliated tribal lender for a loan. If you do not agree, do not submit your Loan Request Form, do not select “Submit Loan Request”. If you do not agree to conduct transactions electronically with Spotloan Plus, to receive Communications by electronic delivery, or to all of the terms and conditions in this E-Consent, do not agree to this E-Consent and do not submit your Loan Request Form.

Technology Requirements for Receiving Communication and Doing Business Electronically

Before you decide to do business electronically with us, you should consider whether you have the required hardware and software capabilities described below.

To receive Communications electronically, you will need:

  • A functioning personal computer, laptop, smart phone, tablet, or other electronic device with an Internet connection (“Device”). The Device must run one of the following operating systems: Windows 7 (NT 6.1) or higher; Apple macOS X 10.13 (High Sierra) or higher; iOS 13.5.1 or higher; or Android 8.0 (Oreo) or higher.
  • An e-mail account, to which we will send all communications.
  • A current web browser that supports 128-bit encryption (e.g., Internet Explorer 11 and above, Microsoft Edge 44.19041, Microsoft Edge 83.0.478.54, Mozilla Firefox 78 and above, Google Chrome 83.0.4103 and above, or Safari 13 and above) with cookies and JavaScript enabled.
  • A current version of a software program that accurately reads and displays PDF files, such as Adobe Acrobat Reader 15 or higher.
  • In order to retain and/or print electronic Communications, your Device will need to be able to save and store Communications and/or you will need a working printer connected to your device.

By proceeding with your credit inquiry or loan request, you acknowledge and agree that you have the technological capacity to receive, access, and retain Communications in the designated formats as described above.

Option for Paper or Non-Electronic Records

You may request a paper copy of any electronic Communication at no charge by emailing us at help@spotloanplus.com or by mailing a written request to P.O. Box 720, Belcourt, ND 58316.

Withdrawing Consent

You may withdraw your consent to receiving Communications electronically by emailing us at help@spotloanplus.com or writing to us at P.O. Box 720, Belcourt, ND 58316. If you withdraw your consent, we may upon notice to you terminate your relationship with us.

Accepting this E-Consent

You agree to notify us immediately of any change in the e-mail address you provided to us by emailing us at help@spotloanplus.com or writing to us at P.O. Box 720, Belcourt, ND 58316.

To accept and agree to this E-Consent, provide your electronic signature clicking “Submit Loan Request” on the Loan Request Form. By clicking “Submit Loan Request” you are providing your electronic signature, you acknowledge you have read, understand, and agree to be bound by this E-Consent and you consent to conduct transactions electronically with Spotloan Plus, and to receive Communications (as defined above) from us electronically.

Spotloan Plus is not a lender or a broker. Spotloan Plus is a free service that matches you with available loan options offered by our tribal lending affiliates. The actual loan terms and APR you qualify for will vary based on your credit score(s) and individual lender requirements and underwriting criteria.

Spotloan Plus is a brand owned by Ningo Lending LLC ("Ningo"), a tribal limited liability company formed under the laws of and wholly owned by the Turtle Mountain Band of Chippewa Indians of North Dakota, a federally recognized Indian tribe (the “Tribe”). Ningo is located on and operates within the Tribe’s reservation. Though Spotloan Plus is available to residents of certain states, consumers should know that loan options presented from our tribal lending affiliates and interest rates may be higher than state-licensed lenders. Although the visitation to this site is electronic, consumers are coming on to the Tribe’s reservation and subject to the Tribe’s jurisdiction to request loan options through Spotloan Plus.

By completing a Spotloan Plus Loan Request form, you are agreeing to allow us to share your information with our available lenders, the Tribe’s lending entities which are Spotloan Plus affiliates, to determine your eligibility for a personal, short-term, installment loan.  If you are eligible for a loan from one of the Tribe’s lending entities, you should read and understand the terms of any loan offered, and should reject any loan offer that you cannot afford to repay or that includes terms that are not acceptable to you. Spotloan Plus is not a loan marketplace for all available lenders and does not provide all loan offers that may be available to you. The loan options offered by our tribal lending affiliates are expensive forms of credit and are not intended to solve longer-term credit or other financial needs. We encourage you to research other available loan options to find the best loan for your situation.

The Loan Request form will allow us to determine if you are a highly qualified consumer eligible for a pre-approved loan of $300.00 or more, with a maximum APR of 34.9%, to be repaid in no less than ninety (90) days. If you do not qualify for these terms you may be eligible for a loan at a higher APR with term lengths between three (3) and ten (10) months. Highly qualified personal loan example: Loan amount: $800.00, Fee: 0%, APR: 34.9%, Term: 10 months, Bi-Weekly Payment: $43.91, Total of Payments: $922.11.  An APR of 34.9% is only available to highly qualified consumers. Not all consumers will qualify. Actual loan terms and APR may vary based on creditworthiness, income verification, and underwriting approval. Not all consumers will be matched with a lender or be presented with loan options.

Spotloan Plus does not perform credit checks. However, we do obtain your consent through the Loan Request form for our tribal lending affiliates to perform a credit check so that they can assess your eligibility for credit, verify your identity, and identify products or services you may prequalify for. Credit checks are usually performed by alternative credit bureaus such as Clarity, DataX, or others, but may include one of the major credit bureaus such as Experian, Equifax and TransUnion. You also authorize Spotloan Plus and the owner of this website to share your information with its tribal lending affiliates. If you do not consent to the sharing of your information or do not want to provide your authorization for a credit check, you should not complete the Loan Request form or use this website.
